Greece transposes into national law EU whistleblower directive Commentary by Kanellos Klamaris and Gregory Karadaidis
Law 4990/2022 (“the Law”) protects those who have obtained information in the course of their work aka whistleblowers on breaches of EU law (e.g. financial law, competition law, anti-money laundering, public procurement, consumer protection)
An obligation of #businesses is established to appoint an Officer who will receive and follow up on internal reports of violations of EU law; the Law also provides for the procedures for internal reporting
Any form of retaliation (e.g. dismissal, defamation, revocation of a license) against protected whistleblowers is prohibited; a rebuttable presumption is introduced in the whistleblowers’ favor pertaining to any detriment suffered by them and suggesting that the detriment was due to reporting or public disclosure
